Facts: Client was prosecuted for High Range drink driving. Client had a head on accident and a blood sample tested at 0.167. The client had not consumed sufficient alcohol to return such a high reading.
Result: Charge dismissed. After thoroughly checking the hospital notes and calling expert evidence we successfully challenged the blood analysis alcohol reading. The handling of the blood sample was called into question and ultimately it was determined that the analysis could not be relied upon.
