Sutherland Local Court

Represented by Solicitor: Jasmina Ceic

Facts: Client was prosecuted for driving with a mid range prescribed concentration of alcohol. Client had 9 minor offences on his traffic record (including speeding offences), but no major offences. He had served 4 weeks off the road before coming to court. Client was a 43 year old salesperson who travelled all around NSW for his work and drove up to 45,000 km per year. He had recently separated from his wife and had 3 children who lived 11km from his home. His employer provided evidence that a loss of licence would mean a loss of employment.

Result: Charge was proven but dismissed under Section 10 of the Crimes (Sentencing Procedure) Act 1999 with a good behaviour bond for 12 months. A condition of the Bond was to complete the Traffic Offenders Intervention Program.
