Facts – the client had attended as social function in Paddington, and had consumed three glasses of wine. Client believed she was not over the legal limit and drove because of this. The client drove to Taren Point, before being detected by RBT. Client failed the road side breath test, and later recorded a breath analysis reading of 0.87, and was charged with Mid-Range drink driving.

Result – the client entered a plea of guilty, and after attending the Traffic Offenders Program, the matter was dismissed under Section 10(1)(b) of the Crimes (Sentencing Procedure) Act 1999, conditional on entering into a good behavior bond for 12 months. The client had her license returned to her at court on the day.
