Facts: Our client was disqualified by a court on a day that he did not attend court.  He did not know that he had been disqualified, although he should have known.  He was overseas at the time that he was disqualified, returned to Australia and drove without checking whether he was disqualified.

Result:Section 10.   No conviction, no further disqualification, no penalty.  The Magistrate accepted our solicitor’s submission that our client did not know that he was disqualified and that to disqualify him further would be unjust.  He left court a very happy man and will soon be in a position to obtain a new licence.
