Facts: Our client indicated there was no mobile phone in his car on that day and that what the police officer had seen was him scratching his ear with his e-tag.

Result:  Our solicitor cross examined the police officer as to the unreliability of what he had seen particularly given the distance, speed of the vehicle, tinting etc.  Our client gave evidence that he had a prior ear operation and it was particularly itchy.  He was found not guilty of the offence.
