Facts: Our client was charged with his 3rd Drive Whilst Disqualified within 7 months, including the breach of a good behaviour bond.  He was at substantial risk of being imprisoned for 2 years with a mandatory minimum disqualification period of 2 years and an additional period of 5 years disqualification by way of habitual offender declaration.

Result:  The Magistrate imposed a suspended gaol sentence, quashed the habitual offender declaration and he left the court that afternoon.
