Waverley Local Court

Represented by solicitor: Robert Hoyles

Facts: Our client said that he was wearing his seatbelt while reversing out of a driveway.  He was charged by police with not wearing a seatbelt whilst driving.

Result: The police officer was cross-examined by our solicitor about the exact observations that he made.  It became clear that the only clear observations of our client not wearing his seatbelt was whilst he was reversing.  Our solicitor then addressed the Magistrate on the technicalities of the Road Rules which allow in certain circumstances a person to not wear a seat belt whilst reversing.  He was found NOT GUILTY of that offence.
