Gosford Local Court

Represented by solicitor: Robert Hoyles

Facts: The police case was that our client had witnessed a serious assault, that he knew or believed who had committed the assault and that he failed to tell police who they were.

Result: Our solicitor dealt with the tender of evidence of over twenty witnesses and cross-examined several witnesses.  We raised the possibility that our client did not know who had committed the offence, that he had never been told and there was simply not enough evidence to support a finding beyond a reasonable doubt.  The Magistrate agreed and he was found not guilty of the offence.
