The Facts: The alleged victim of an attempted murder was cross examined about the marital relationship and the violence exhibited during a long marriage.

The Result: The answers given were able to be compared with independently obtained evidence. The combined information was essential in establishing the accused’s state of mind by way of a psychiatric report as well as demonstrating that the witness’s evidence was unreliable, generally untruthful on material points and contradicted by independent evidence.

The accused was found not guilty at trial.
