CASE STUDY – Break and Enter with Intent to Commit Indictable Offence

The Facts: Client in an on-again off-again relationship. Although he would regularly attend his girlfriend’s place, he was asked not to go there after a telephone tiff. He went there and let himself in. they argued. By letting himself in, police said that he had broken in.

The Result: Not guilty. Simply being told on the phone not to come over after an argument on the phone did not disentitle the accused to attend his girlfriend’s place and let himself in as he had many times.
