CASE STUDY – Sexual Assault – jury trial

The Facts: Client charged with Aggravated Sexual Assault; Break and Enter with Intent to Commit Indictable Offence; client had criminal record; DNA evidence confirmed sexual acts; issue was consent

The Result: Not guilty. Extensive investigation by criminal defence lawyer resulted in CCTV footage being located that totally disproved behavior alleged against accused prior to sexual act. Witnesses were located and phone records produced on subpoena also established complainant as being a liar. Client had been bail refused for 12 months leading up to the trial. Plea of guilty to damaging property accepted and client immediately released from custody.
