Facts – the client attended a football match at the Sydney Football Stadium, where he became heavily intoxicated. In wandering around the ground, the client walked into a staff area of the stadium, and attempted to steal various personal items belonging to stadium employees. The client was immediately detected, arrested and charged with larceny.  The client had numerous past convictions form other offences involving alcohol.

Result – charge dismissed under section 10(1)(b) of the Crimes (Sentencing Procedure) Act  1999, condition on the client entering into a good behavior bond, and complying with Probation and Parole supervision for alcoholism. The Magistrate accepted that the incident was more of a drunken prank, and that given the client’s intoxication, action should have been taken earlier to ensure that he was not served further alcohol.
