Facts: Client was prosecuted for possession of a small quantity of cannabis.  He was also found to be in possession of white powder which police believed to be cocaine – despite the client telling them it was Xanax (a prescribed restricted substance used for the treatment of anxiety).  Since police believed he was not being truthful, they declined to proceed by way of cannabis caution and prosecuted him in court.  Our client had no prior criminal record.

Result: No conviction was recorded pursuant to section 10 Crimes (Sentencing Procedure) Act.  The white powder was analyzed and found to be Xanax – exactly what our truthful client had said.  The client had real prospects of traveling and working overseas – something that may have jeopardized if a conviction were recorded.  His good character was of assistance to him.  He was very happy with the outcome.
