Sydney District Court

Represented by Solicitor: Philip Stewart

Facts: Client charged with aggravated indecent assault.  He was in a relationship with a woman.  The relationship broke up and there were custody issues between the accused and the alleged victim’s mother which were not disclosed to police.  The accused insisted that the complaints were fabricated.

Result: Not guilty on both counts.  Evidence of the custody issues relating to the alleged child victim came out during the trial which comfortably allowed the jury to decide that the complaint was false, the evidence not credible, or both.

Aggravated Indecent Assault is a serious charge that carries consideration of a standard non-parole period of time in prison upon a finding of guilt. The client’s solicitor, Philip Stewart is a Partner of Nyman Gibson Stewart and an accredited specialist in criminal law.
