Can Police Arrest for Questioning?

Police can arrest you if they believe on reasonable ground that you have committed an offence – however they may NOT arrest you for the purpose of questioning.

Police might ask that you accompany them to a police station for questioning – ASK THEM IF YOU ARE UNDER ARREST. If you are not under arrest, you are not obliged to go with them and you are not obliged to answer any of their questions (unless they disclose a positive duty to answer in limited circumstances)

Until such time that you have spoken to one of our specialist criminal lawyers, we advise you not to speak with the police.
