Our client was disqualified by a court on a day that he did not attend court. He did not know that he had been disqualified, although he should have known. He was overseas at the time that he was disqualified, returned to Australia and drove without checking whether he was disqualified.
After making submissions, the magistrate dealt with the matter pursuant to Section 10 of the Crimes (sentencing Procedure) Act. No conviction, no further disqualification, no penalty. The Magistrate accepted our solicitor’s submission that our client did not know that he was disqualified and that to disqualify him further would be unjust.
